These are our Terms of Use. It is important that you read through this document as it describes your rights as well as a number of obligations that apply to you as a user. You can also find our Privacy Policy here. It describes how we use cookies, process your personal data, what we do to protect it, and where you can turn if you have any questions about our processing of personal data.

Prerequisites

To use the Service, you must have VR glasses. We can only recommend training with the model sold by Imvi Labs, as the training is optimized for this model.

Our Terms

These Terms of Use and the Privacy Policy (the “Terms”) are established by Imvi Labs AB, company registration number 559330–4651 (“Imvi Labs”, “we”, “us” or “our”). The Terms apply to you as an individual or legal entity (the “Customer” or “you/your”) who has either (i) registered as a user of any of Imvi Labs’ services/applications (collectively, the “Service”), or (ii) entered into a separate subscription agreement for use of the Service. Together, these constitute the agreement (the “Agreement”) between you and Imvi Labs.

If you as a Customer are under 18 years of age, both you and your legal guardian must approve these Terms on your behalf. By accepting these Terms, you as the legal guardian of a Customer under 18 confirm that you consent to the Agreement being entered into between Imvi Labs and the Customer.

Service

The Service means Imvi Labs’ eye-coordination training to improve binocular vision, including all functionality, interfaces, and content that Imvi Labs makes available from time to time through the Service on websites and in various applications. Certain parts of the Service may be provided free of charge. Other parts must be paid for before you can use them. The parts of the Service that can only be accessed after payment are referred to as the “Paid Service”. The parts of the Service that do not require payment are referred to as the “Free Service”. You can read more about the Service by visiting our website at www.imvilabs.com.

We may sometimes offer trial versions of the Paid Service for a certain period, either free of charge or at a reduced price (a “Trial Subscription”). The purpose of a Trial Subscription is to allow users to test the Paid Service, or parts of it, for a limited period in order to form an opinion of the Service.

Imvi Labs reserves the right to change the Service at any time. This means, for example, that the content, structure, functionality, and search system of the Service may change over time. Any change to the Service that substantially reduces its usefulness must be communicated at least one (1) month in advance. You then have the right to terminate the Agreement and, if you use the Paid Service, you may also request a refund of fees already paid, up to an amount corresponding to the remainder of the current period. You may only request a refund if you also terminate the Agreement (see below). If you continue to use the Service after a change has been made, you will be deemed to have accepted the change. You are not entitled to any other compensation as a result of changes to the Service.

Trial Subscription

Payment

Payment is made using one of the payment methods we offer on our website.

From time to time, we may offer subscription services provided through third parties. Such services may be subject to separate terms and conditions; where applicable, those terms may apply in addition to these Terms. The subscription service is subject to a monthly subscription fee. We reserve the right to change/update the monthly fee. Such a change/update may apply during the service period or after the service period has ended. If the service is subject to a fixed commitment period and that period expires, the agreed subscription service will continue unless you cancel it, which you can do through My Account.

License Grant and Your Rights as a User

Intellectual Property Rights

The Service, all data generated, and all intellectual property rights belong to Imvi Labs and/or Imvi Labs’ licensors. The Agreement does not transfer any intellectual property right, or part thereof, to the Customer beyond the right of use specified in the Agreement. This also means that you may not analyze, examine, modify, copy, distribute, sell, or otherwise exploit the Service in any way relevant from an intellectual property perspective, except as permitted by this Agreement or mandatory applicable law.

License Grant

Imvi Labs hereby grants you a non-exclusive right to use the Service during the term of the Agreement (see below regarding the term of the Agreement), subject to the terms of this Agreement and the rights and limitations that apply depending on whether you have activated the Paid Service or are using the Free Service. The license is granted to a specific named individual, or to a specified number of users, in accordance with any separate subscription agreement or the Customer’s registration.

The following also applies to individuals. Users with an individual subscription have the right to use the Service for personal use. Each user account is personal and may not be shared with others. Access to the Service is provided once registration has been completed and the Terms have been accepted. The Service is deemed delivered when the Customer receives access to the Service after completing registration and accepting the Terms.

The following also applies to legal entities. Users with a subscription through a legal entity have the right to use the Service for the number of users agreed upon when entering into any separate subscription agreement. The Customer is responsible to Imvi Labs for ensuring that its users comply with this Agreement. Access to the Service is provided once registration has been completed, the Terms have been accepted, and the necessary access details have been received by a designated contact person on behalf of the Customer by email. The necessary access details are sent as soon as the Customer has provided its contact details and these have been registered by Imvi Labs. The Service is deemed delivered when the access details have been sent to the Customer.

Term, Termination and Suspension

Term and Termination Without Cause

This Agreement remains in effect until terminated by either you or Imvi Labs. Both parties have the right to terminate the Agreement and your use of the Service at any time, effective when the current paid subscription period expires. If you use the Free Service, the Agreement and your right to use the Service end immediately.

Termination Due to Breach of Contract

Imvi Labs has the right to terminate this Agreement with immediate effect if the Customer materially breaches the Agreement. You may be required to compensate Imvi Labs for any damage Imvi Labs suffers as a result of a breach of contract, for example if you use the Service in violation of the license terms above or enable others to gain unauthorized access to the Service.
