TERMS OF SERVICE
These are our terms of service and it is important that you read through this document as it describes your rights but also a number of obligations you have as a user. You can also find our privacy policy here. We describe how we use cookies, process your personal data, what we do to protect them, and where you can turn if you have any questions about our personal data processing.
Prerequisites
To be able to use the Service, you must have VR glasses. We can only recommend training on the model that Imvi Labs sells, as the training is optimized for this.
Our Terms
These terms of service and privacy policy ("Terms") are established by Imvi Labs ab, org. no. 559330–4651, ("Imvi Labs" and "we/us/our"). The Terms apply to you as a private individual or legal entity ("Customer" or "you/your") who (i) registered as a user in any of Imvi Labs services/applications (collectively "Service"), or (ii) entered into a separate subscription agreement for use of the Service. These together constitute the agreement ("Agreement") entered into between you and Imvi Labs.
If you as a Customer are under 18 years old, both you and your guardian must approve these Terms on your behalf. By approving these Terms, you confirm as a guardian for a Customer under 18 years that you consent to the Agreement being entered into between Imvi Labs and the Customer.
Service
The Service refers to Imvi Labs eye coordination training to improve binocular vision including all functionality, all interfaces, and all content that Imvi Labs makes available from time to time through the Service on websites and in various applications. Certain parts of the Service may be provided free of charge. Other parts of the Service you must pay for before you can use them. The parts of the Service that can be accessed only after payment are called "Paid Service." The parts of the Service that do not require payment are called "Free Service." You can learn more about the Service by visiting our website www.imvilabs.com.
We sometimes offer trial versions of the Paid Service for a certain period, without requirement for payment or at a reduced price (a "Trial Subscription"). The purpose of a Trial Subscription is for users to be able to test the Paid Service, or parts of it, for a limited period in order to form an opinion about the Service.
Imvi Labs reserves the right to at any time freely modify the Service, which means that, for example, the Service's content, structure, functionality, and search systems may change over time. A change to the Service that materially reduces the benefit of the Service must be notified at least one (1) month in advance. You then have the right to terminate the Agreement and if you use the Paid Service you may also demand a refund of already paid fees up to a special amount that corresponds to what remains of the ongoing period. You can only demand a refund if you simultaneously terminate the Agreement (see below). If you continue to use the Service after a change has been made, you will be deemed to have accepted the change. You have no right to claim other compensation because the Service changes.
Trial Subscription
We sometimes offer trial versions of the Paid Service for a certain period, without requirement for payment or at a reduced price (a "Trial Subscription"). The purpose of a Trial Subscription is for users to be able to test the Paid Service, or parts of it, for a limited period in order to form an opinion about the Service.
Payment
Payment is made via one of the payment methods we offer on our website.
We may from time to time offer subscription services that may be provided through third parties. These services may then be subject to different terms; if so, such terms may apply together with these. The subscription service is governed by a monthly subscription fee. We reserve the right to change/update the monthly cost. This change/update may be applicable during the service period or after the service's duration is over. If the service is governed by a binding period and the binding period expires, the agreed subscription service will continue if you do not cancel it, which you do under My Pages.
License Grant and Your Rights as a User
Intellectual Property Rights
The Service, all data generated, and all intellectual property rights belong to Imvi Labs and/or Imvi Labs licensors. The Agreement does not result in any intellectual property right or part of such right, beyond the right of use specified in the Agreement, transferring to the Customer. This also means that you do not have the right to analyze, investigate, modify, copy, distribute, sell, or otherwise dispose of the Service in any intellectually property-relevant way other than what follows from this Agreement or mandatory legislation.
License Grant
Imvi Labs hereby grants you a non-exclusive right to use the Service during the contract period (see below regarding the contract period) on the conditions that follow from this Agreement and with the rights and limitations that follow from your either having activated the Paid Service or using the Free Service. The license is granted to a certain named person, or to a certain number of users, in accordance with what has been agreed in any separate subscription agreement or upon the Customer's registration.
Furthermore, the following applies to private individuals. Users with private subscriptions have the right to use the Service for personal use. Each user account is personal and may not be shared with others. Access to the Service is obtained when registration is completed and the Terms are accepted. The Service is deemed delivered when the Customer obtains access to the Service after registration has been completed and the Terms have been accepted.
Furthermore, the following applies to legal entities. Users with subscriptions through a legal entity have the right to use the Service for the number of users agreed upon when concluding any subscription agreement. The Customer is responsible to Imvi Labs for ensuring that its users comply with this Agreement. Access to the Service is obtained when registration is completed, the Terms are accepted, and necessary information for access to the Service has been received by a contact person designated on behalf of the Customer via email. Necessary information for access to the Service is sent as soon as contact information is provided by the Customer and registered by Imvi Labs. The Service is deemed delivered when access information is sent to the Customer.
Contract Duration, Termination, and Suspension
Contract Duration and Termination Without Cause
This Agreement remains in effect until it is terminated by either you or Imvi Labs. Both parties have the right to terminate the Agreement at any time and your use of the Service when your ongoing paid subscription period expires. If you use the Free Service, the Agreement and your right to use the Service terminate immediately.
Termination Due to Breach of Agreement
Imvi Labs has the right to terminate this Agreement with immediate effect if the Customer breaches the Agreement in any material respect. You may be obligated to compensate Imvi Labs for any damages that Imvi Labs suffers as a result of a breach of contract, for example if you dispose of the Service in violation of the license terms above or enable others to obtain unauthorized access to the Service.
Temporary Suspension of Service
Imvi Labs may from time to time temporarily limit or shut down your access to the Service, for example during maintenance of the Service. Imvi Labs also has the right to block your access to the Service if you have or Imvi Labs has reasonable cause to suspect that you have used the Service, its content, or Imvi Labs intellectual property rights in violation of the Agreement. If you do not pay your subscription fee on time, Imvi Labs also has the right to block your access to the Paid Service.
Right of Withdrawal
According to the law (SFS 2005: 59) on distance contracts and contracts outside business premises (distance contracts law), if you are a consumer, you have the right to withdraw within 14 days of the day the subscription agreement is entered into. You withdraw from your purchase by notifying Imvi Labs by email. For health and hygiene reasons, VR glasses can only be returned in original condition and in an unopened original package.
Assignment and Transfer
The Customer does not have the right to, without Imvi Labs' consent, assign or transfer their rights or obligations under the Agreement.
Use and Responsibility
The Customer undertakes not to disclose username and password to any unauthorized person and to ensure that documents such as username and password for the Service are kept in such a way that unauthorized persons cannot gain access to them. The Customer shall immediately notify Imvi Labs if it is feared that any unauthorized person has become aware of the Customer's password or gained access to the Customer's account.
Support
Imvi Labs provides support for the Service via email and we always try to respond within 48 hours, although we cannot always guarantee that you will receive an answer within this time. Support is provided via support@imvilabs.com. If you want to end your subscription, you can do so by contacting support, and we will help you terminate your subscription.
Notices
Notices from Imvi Labs to the Customer sent to the email address provided by the Customer and/or to the Customer's specified mobile phone number shall be deemed to have reached the Customer one day after the message is sent.
Limitation of Liability
Imvi Labs assumes no responsibility for any errors and defects in the content of the Service or in its availability, and you acknowledge that you understand that no software or digital service is completely error-free and that, for example, bugs may occur in the Service. Imvi Labs is also not responsible for any damages, whether direct or indirect, caused by or arising from the use of the Service, including any damages resulting from the Service not being able to be used as intended, for example when the Service is temporarily down or experiences disruptions.
Changed Terms
Imvi Labs reserves the right to change the Terms from time to time. Notice of change is communicated on the Service's website at least 14 days before the change comes into effect, and may also be communicated to the Customer via specified contact information to the specified address within the same time frame. Changes are binding on the Customer unless the change can reasonably be said to constitute a material inconvenience for the Customer and the Customer notifies Imvi Labs of immediate termination of the Service no later than 7 days after receiving notice of an upcoming change. The Agreement then ceases to apply as soon as Imvi Labs receives notice of termination.
